China National Institute of Standardization (CNIS)

Notice of Intent to Solicit Comments on National Standard “Disposal Rules for Inclusion of Patents in National Standards” (Draft)

released for public comment  January 28, 2010 with deadline for comment March 1, 2010

The official Chinese text of the notice  can be accessed through:  http://www.cnis.gov.cn/wzgg/bgsgg/201001/t20100129_5596.shtml

The document CNIS has made available for comment  “Disposal Rules for Inclusion of Patents in National Standards”   is a key element in the proposal  by the  Standardization Administration of China (SAC) November 2009  “Regulations on Administration of Formulating and Revising National Standards Involving Patents”

Article 17 The patent information disclosure and the licensing statement shall be implemented as required by the Rules for Disposal of the Patents Involved in National Standards.

Thus this standard  has  strategic implications for all business sectors within and outside  of China with stakes in a global market resting on standards and intellectual property.  This standard deserves careful review and comparison with global norms and full utilization of the comment process afforded by CNIS to parties within China and to the global community.

GTW Associates commented upon  the Standardization Administration of China (SAC) November 2009  “Regulations on Administration of Formulating and Revising National Standards Involving Patents” and  commented upon the CNIS “Disposal Rules for Inclusion of Patents in National Standards”  February 28

The notice in the URL above   refers to and contains links to  four additional documents:  a cover note with administrative information and deadlines for commenting and links to three substantive appendices:

First and most importantly ... the National draft national standard upon which comments are solicited:

1. Disposal Rules for Inclusion of Patents in National Standards (Draft for Comments)

Second and very helpfully ... a "rationale" of the authors for the elements of the standard combined with  a sort of  development history of the standard  described as:

2. Compilation Notes

and lastly a form to be used to  help structure a  review thereof to come up with specific revision suggestions along with a caution that any  entity that provides no feedback will be put on record as having approved the draft:

3. Feedback Form

The remainder of the cover note concludes:

Please fill out the “Solicit Comments on National Standard” form and then return it to the contact person before March 1, 2010 via letter, fax or email.
